By using services from MADNAN Creations and completing a booking, you are bound by the Terms and Conditions (T&C) and Privacy Policy outlined below. These policies apply to you as a user of MADNAN Creations and its subsidiaries/partners. Please note that MADNAN Creations reserves the right to modify or update these T&C and Privacy Policy, either in part or entirely, without any obligation to provide prior notification. Consequently, the terms that will apply in the future may differ from those currently in effect.

  1. Overview
    • MADNAN Creations operates as an online freelance photography/videography service available through its website, www.madnancreations.com (hereinafter referred to as “The Site”) and social media (Instagram/Facebook/YouTube: @madnan.creations), which enables users to book photo/video sessions in various cities across Japan by selecting a photographer. Our top priority is to ensure the protection of our customers’ private information. These Terms and Conditions (T&C) also encompass the Privacy Policy and govern the collection and use of all data by MADNAN Creations, including data obtained through the Site. By accessing and using the Site, you indicate your consent to the data collection and usage practices described in this Policy.
  2. Data Collection
    • MADNAN Creations gathers personal data about you, including but not limited to your name, email, demographic information such as age and gender, as well as information about your past travel experiences. This data is collected to enhance your user experience, provide relevant information, and facilitate the completion of your purchased transactions.
    • To personalize your online experience, MADNAN Creations utilizes cookies. Cookies are small text files placed on your hard disk by a web page server. They are uniquely assigned to you and can only be read by a web server in the domain that issued the cookie.
    • Cookies primarily serve as a convenience feature, saving you time by indicating your return to specific pages. You have the option to accept or decline cookies, as most web browsers automatically accept them. However, you can modify your browser settings to decline cookies if you prefer.
    • MADNAN Creations also retains information about your computer hardware and software, such as your IP address, browser type, domain names, access times, and referring website addresses. This information is used to operate the service, maintain its quality, and provide general statistics about the Site’s usage. By using MADNAN Creations, you consent to the collection of your personal information. Rest assured, your information will not be sold or shared with third-party services/products unrelated to MADNAN Creations.
    • It is advisable to review the privacy statements of websites you access via links on the MADNAN Creations website to understand their data collection, usage, and sharing practices. Please note that MADNAN Creations is not responsible for the privacy statements or content found on external websites outside of the Site.

Rest assured, MADNAN Creations does not sell, rent, or lease customer lists to third parties.
    • To enhance the user experience, MADNAN Creations tracks the websites and pages visited by users within the MADNAN Creations platform. This information helps determine the most popular MADNAN Creations services. It is used to deliver customized content and targeted advertising to customers who have shown interest in specific subject areas.
    • Please note that MADNAN Creations will only disclose your personal information if required by law or in good faith belief that such action is necessary to: (a) comply with legal obligations or legal process served on MADNAN Creations or the Site, (b) protect and defend the rights or property of MADNAN Creations, or (c) act in urgent circumstances to ensure the personal safety of MADNAN Creations users or the public.

  4. Security of Your Personal Information

  5. Email & Promotions
    • MADNAN Creations may periodically contact you via email or other channels to provide updates on special promotions or events related to MADNAN Creations. By using our services, you agree to subscribe and receive these emails and messages. However, you have the option to unsubscribe at any time by contacting us.
  6. Opt-Out & Unsubscribe
    • Respecting your privacy, we offer you the opportunity to opt out of receiving certain information announcements. If you wish to unsubscribe from any or all communications from MADNAN Creations, please contact us using the contact information provided in the Contact Information section of this Policy.
  7. Copyright
    • Regarding the copyright ownership of the pictures from your photo/video sessions, both you as our client and MADNAN Creations will jointly own the copyrights. By using MADNAN Creations, you grant us permission to utilize the photo/video sessions pictures at our discretion on our owned media channels, including but not limited to the MADNAN Creations SITE and SOCIAL MEDIA ACCOUNTS (Instagram/Facebook/YouTube/TikTok/Twitter).
    • You acknowledge that MADNAN Creations will retain the copyrights of all the photos created and produced by MADNAN Creations. We reserve the right to use them for promoting the MADNAN Creations business. Consequently, you grant MADNAN Creations consent to publish, display, or use all the photographs and videos produced by MADNAN Creations for the benefit of MADNAN Creations (e.g., editorial and exhibition purposes). By doing so, you release any rights to claim profit or further compensation arising from such use.
    • While MADNAN Creations strives to obtain your permission before using your pictures on external media channels not owned by MADNAN Creations, it is important to note that you release MADNAN Creations from any liability related to libel, invasion of privacy, or any other causes of action in connection with the making and use of the photos, including any alterations that may occur during the production, editing, or subsequent use of the photos.
  8. Booking and Advance Payment
    • MADNAN Creations operates as a reservation system for photographers. After your initial contact with us you will pay an “Advance payment” to confirm your booking. You will pay 20% of the your selected package/packages as advanced payment. After transferring the amount of the advanced payment to us, we will schedule an online meeting to plan the details and location of the photo/video sessions.
    • The “Advance payment” should be transferred at least 7 days before the scheduled photo/video session.
    • When you book a photographer for a specific time frame, such as from 4 pm to 6 pm, the photographer’s availability is limited to those two hours. Any travel time from point A to B or delays caused by late arrival will be deducted from the reserved 2-hour photo/video sessions.
    • You can pay the rest of the payment in cash in JPY to the photographer on the day of the photo/video sessions.
  9. Photo/Video Editing
    • We will enhance all the images provided to you, focusing on brightness and color adjustments. However, we do not perform extensive Photoshop edits to alter body proportions or remove objects. Photo edit and retouching does not include any changes to the environmental elements and permanent features of your body. Our editing style aims to bring out the beauty of the photos/videos. Please note that MADNAN Creations has its own editing style, and requests for a different editing style may not be accommodated.
  10. Delivery
    • You can expect the edited photos to be delivered within 7~15 days after the photo/video sessions unless other time schedule for delivery has been agreed.
    • Photos will be shared via Google Drive. Please download the photos within 7 days after we notify you. The photos will be removed from cloud after 7 days.
  11. Payment and Currency
    • MADNAN Creations displays pricing JPY and all payments will be processed in JPY. If you pay through online payment methods (PayPal, Credit cards, Stripe, etc.) transaction, currency conversion, and other fees will be added to the listed pricing in the Packages page (www.madnancreations.com/packages), so that we receive the exact prices listed on the Packages page. Payment in cash in JPY does not require any extra fees.
    • We accept PayPal, credit cards, Stripe, and local bank tranfers.
  12. Travel Expense
    • Our photographers are local professionals based in the city where your photo/video sessions will take place. Therefore, there are no additional travel or accommodation expenses associated with their services. However, if you plan to have your photo/video sessions in remote locations more than one hour away from the city center, there may be an additional charge. We recommend checking with us before making your booking.
  13. Other Expenses
    • The fee for the photo/video sessions does not cover entrance fees to places like theme parks. If there is an entrance fee required for the location you choose, you will be responsible for covering the entrance fee for the photographer.
  14. Theft
    • MADNAN Creations is not liable for any theft that may occur during the duration of your photo/video sessions. It is your responsibility to ensure the safety of your belongings.
  15. Refund Policy
    • If you need to cancel your photo/video session, you can receive a full refund if you notify anytime before the scheduled online meeting for the planning of the photo/video sessions. The refund policy is as follows:
      • Cancellation requested anytime until before the scheduled online meeting for the planning the photo/video sessions: 100% refund of the money transferred to us excluding transaction, currency conversion, and other fees.
      • Cancellation requested after the scheduled online meeting for planning the photo/video sessions: The “Advance payment” will not be refunded and it will be charged as a consultation fee for the online meeting. Any money transferred to us other than the advanced payment will be refunded excluding transaction, currency conversion, and other fees.
    • Failure to show up for the photo shoot: 0% refund.
  16. Injury
    • By booking a photo/video session with MADNAN Creations, you agree to waive certain legal rights and release MADNAN Creations from any liability. This includes any claims for personal injury, death, property damage, or other loss that may occur during or as a result of the MADNAN Creations photo/video session. You also agree to hold MADNAN Creations harmless from any liability for property damages or personal injuries to any third party resulting from your photographic activities or related activities during the photo/video sessions.
  17. Changes To This Policy
    • MADNAN Creations may update its Privacy Policy from time to time based on company and customer feedback. It is recommended to periodically review the policy to stay informed about how MADNAN Creations protects your information.

I CONFIRM THAT I HAVE READ AND UNDERSTOOD THIS RELEASE AGREEMENT PRIOR TO BOOKING MY PHOTO/VIDEO SESSION WITH MADNAN Creations AND I AM AWARE THAT BY SIGNING THIS RELEASE AGREEMENT I AM WAIVING CERTAIN LEGAL RIGHTS WHICH I OR MY HEIRS, NEXT OF KIN, EXECUTORS, AND ADMINISTRATORS, ASSIGNS, AND REPRESENTATIVES MAY HAVE AGAINST MADNAN Creations, its employees, directors, shareholders and the photographers.
